Terms of Service
Last updated: August 2026. This is a plain-language summary of how the Echo Softworks marketplace works — it isn't a substitute for a lawyer's review, but it covers the essentials.
1. What this is. Echo Softworks operates a marketplace where independent sellers ("Sellers") list digital assets — game dev assets, web templates, hardware/embedded project files, CAD files, and code — for sale to buyers ("Buyers"). Echo Softworks is the operator of the platform, not the creator of listed items unless explicitly stated.
2. Accounts. Selling requires an account, created via a passwordless email sign-in link. You're responsible for keeping access to the email address tied to your account. Buyers do not need an account to purchase.
3. Payments and fees. Payments are processed by Stripe. Buyers are charged the listed price in full. Echo Softworks deducts a platform fee (currently 4–7%, shown at time of listing and again at checkout, varying by category) from the Seller's payout; the remainder is transferred to the Seller's connected Stripe account. Echo Softworks is the merchant of record for these transactions, meaning charges appear under the Echo Softworks name on a Buyer's statement, and Echo Softworks handles initial dispute intake even though funds are split with the Seller.
4. Seller payouts. Sellers must complete Stripe Connect onboarding (identity verification and bank details, handled entirely by Stripe) before receiving payouts. Echo Softworks never collects or stores Seller banking details directly.
5. Listings go live immediately. Listings are published as soon as a Seller submits them — there is no manual review queue before a listing appears in the marketplace. Echo Softworks reserves the right to remove or suspend any listing at any time, including after publication, for any reason including but not limited to: intellectual property infringement, malicious code, misleading descriptions, or violation of these Terms.
6. Seller responsibilities. By listing an item, a Seller represents that: they own or have the rights to sell the listed content; the listing description is accurate; the files do not contain malware, exploits, or content that infringes on any third party's rights; and the item complies with the license terms stated on the listing. Sellers are solely responsible for the accuracy, quality, functionality, and legality of what they list.
7. Buyer responsibilities. Purchases grant the license stated on the listing at time of purchase — nothing more. Redistributing, reselling, or sublicensing a purchased asset beyond its stated license terms is a violation of these Terms and may violate the Seller's copyright.
8. Refunds and disputes. Refund requests should first be directed to the Seller. Echo Softworks may issue a refund at its discretion in cases of non-delivery, files that don't match the listing description, or fraud. Chargebacks initiated through a Buyer's card issuer are handled per Stripe's standard dispute process; a Seller's payout for a disputed transaction may be reversed or held pending resolution.
9. Prohibited content and conduct. No listings containing malware, exploits, stolen assets, content infringing third-party IP, or anything illegal to sell in your jurisdiction. Echo Softworks may suspend accounts or remove listings without notice for violations.
10. Platform availability. The marketplace is provided as-is. Echo Softworks does not guarantee uninterrupted availability and is not liable for losses arising from downtime, data loss, or third-party service outages (Stripe, Supabase, or otherwise).
11. Limitation of liability. To the maximum extent permitted by law, Echo Softworks' total liability for any claim arising from use of the marketplace is limited to the platform fees Echo Softworks collected on the transaction(s) giving rise to the claim.
12. Changes to these terms. Echo Softworks may update these Terms from time to time. Continued use of the marketplace after changes are posted constitutes acceptance.
